  1. OBJECT

These general terms and conditions define the rights and obligations of the parties in connection with the booking of holiday rentals furnished by Seaflats. They govern all the steps necessary for the reservation and the follow-up of the reservation between the contracting parties. The customer acknowledges having read and accepted these general conditions of sale and the conditions of sale of the price proposed on our booking platform. These general conditions of sale apply to all bookings concluded.

  1. RESERVATION

The customer chooses the services presented on our website, brochure or booking platform. He acknowledges having taken knowledge of the nature, destination and booking conditions of the services available and has requested and obtained necessary and / or additional information to make his reservation in full knowledge of the facts. The customer is solely responsible for his choice of services and their suitability for his needs, so that our responsibility can not be sought in this regard. The reservation is deemed accepted by the customer at the end of the booking process.

  1. REGLEMENTS

A deposit of 30% will be asked for your booking for any stay starting more than 7 days after this date. The balance must be collected (check / transfer) or will be collected (credit card) 7 days before arrival. This flow will emanate from SARL Le Kerdreuz, a company marketing the Seaflats apartments.

Upon receipt of the deposit payment, you will receive a confirmation email containing the practical information of your stay. The full amount will then have to be paid at least 7 days before your arrival at the Seaflats apartment, if necessary this amount will be directly charged. This except for a reservation made less than 7 days before arrival, the amount will then be paid in full.

  1. MEANS OF PAYMENTS ACCEPTED

 

  1. ACCOMMODATION CAPACITY

The number of people mentioned per accommodation in our rates corresponds to the maximum occupancy allowed given the available equipment. It can not be exceeded for reasons of security and insurance.
The rental of one of our appartment implies the total acceptance of the terms of sales by the contracting parties.

  1. LOCATIONS

Rental periods and duration : rentals are possible for 2 nights minimum except school holidays.
The rental price includes : the rental of the apartment for the duration of the stay with its equipment, the cleaning fee 5 to 6 times a week, bed linen and towels on arrival, the charges of the condominium, water consumption, cable TV, WiFi, 1 place in the parking of the residence and access to reception and reception services of the residence (unless otherwise specified in the offer). Price does not include : extras, electricity consumption and fees (package of 80R$ per stay, payable locally), change of bed linen and towels (optional) which will be returned in good condition at the end of the rental and generally all services not included in your package.
Rentals are available from 2 pm on the day of arrival and must be vacated by 11 am on the day of departure. Any overrun results in the billing of an extra day. Depending on availability, it is possible, with the option and after approval of the company, to request a late departure.
Assignment, subletting : All rentals are nominatives and can not be give in or sublet.
Security Deposit : Renters must provide a check deposit or credit card imprint upon arrival. The latter will only be debited if there is: deterioration of the equipment, inventory of output not conforming to that of arrival, or for additional services ordered during your stay in one of our apartments and not paid. The security deposit will be returned in full up to 15 days after the day of departure after a good inventory and exit inventory. Otherwise it will be deducted from the deposit :

– The value of the missing objects ;
– A fixed sum of € 65 for inadequately cleaned installations (at least dishwashing done, garbage outlets and accommodation returned in the same general condition as it was found) ;
– The amount of repairs in case of deterioration due to the occupant ;
Degradations, missing items or unpaid debts, in excess of the amount paid as a deposit, will be charged to the customer after deduction from the deposit.
Rates are inclusive of VAT with a VAT rate of 10% applicable on the day they were determined. Any subsequent change in the applicable VAT rate, which occurred between the time the rates were determined and the billing of the stay, will result in a consequential change in the price including VAT, which the customer accepts without reserve. The rate of services ancillary to the stay is determined with a VAT rate of 20%.
Minors must be accompanied by their parents or guardians.
Special request : Seaflats can not guarantee any particular request made during the reservation.
The plans and photos presented in brochure and on our websites are not contractual. Seaflats reserves the right to update and complete them at any time. Even if we do our best so that the photographs, graphical representations and texts reproduced to illustrate the accommodations presented give an overview as accurate as possible of the services offered, variations may occur between the time of the reservation and the day of consumption of the service.

  1. SETTLEMENT OF YOUR STAY

The reservation of the stay becomes effective only after confirmation by our services and payment by the renter of the deposit.

In the case of a payment by credit card, there can be a refusal of the payment card for several reasons: card stolen, card blocked, ceiling reached, error of seizure … In case of problem, the customer will have to get closer to his bank on the one hand, the establishment on the other hand to confirm his reservation and his method of payment.

Taxes (local taxes, tourist taxes, etc … unless mentioned as included in the displayed price of your accommodation), are to be paid directly on site with the establishment.

The booking fees are included in the R$80 package mentioned in 6.

All bookings, regardless of their origin, are payable in the local currency of the establishment, unless otherwise specified on site. If the debit at the property is in a currency other than that confirmed on the booking, the exchange costs are the responsibility of the customer.

  1. MODIFICATION OF THE STAY

Possibility of modification subject to availability. Any modification entails an additional processing fee of 10€.

  1. DELAYED ARRIVALS / EARLY DEPARTURES

In the absence of written message from the client, stating that he had to postpone the date of his arrival, the accommodation becomes available 12H (twelve hours) after the date of arrival provided by the lease, and at the latest before midnight. Full payment of rental and services will be required.
No reduction will be granted in the case of delayed arrival or early departure.

  1. PROMOTIONS – LAST MINUTE SALES

On these occasions, it is possible that for the same stay, customers have paid different prices. Customers who have paid the highest price will not be able to benefit from a refund representing the price difference they have paid and the promotional price. The discounts are not cumulative with promotions. The price confirmed to the customer remains a non-revisable price.

  1. CANCELLATIONS

Cancellation of your stay BY SEAFLATS before your arrival : In case of force majeure, the management reserves the right to cancel your stay for security reasons. If you have already left your home, we will offer you to relocate to another similar accommodation without supplement.

If none of these offers satisfies you, the full amount paid will be reimbursed ; no other compensation can be claimed.

Cancellation of your stay BY YOURSELF before your arrival : you must inform Seaflats in writing (mail followed, email with request for acknowledgment of receipt). Otherwise, the customer will be required to pay all amounts due under the contract. Seaflats reminds you that according to Article L.121-20-4-2 ° of the Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering and leisure services provided to a date according to a specified periodicity.

Any booking or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the customer will result in the cancellation of the reservation at the expense of the customer, without prejudice to any civil or criminal action against the latter.

For any stay canceled before the date of arrival, and not included in the cancellation clauses mentioned above, we will retain :

  • For cancellations more than 45 days before arrival : no fees ;
  • Between 45 and 7 days : 70% of the total amount of your stay ;
  • For cancellations less than 7 days before arrival as well as for any stay interrupted or not consumed, for any reason whatsoever, the total amount of the reserved stay will be owed or will remain acquired to Seaflats.

For any type of cancellation, the amount of the fees (10€ – ten euros) will be retained on the amount paid back to the customer.

  1. ANIMALS

Pets are not allowed in our rentals.

  1. VALUABLE GOODS

Safes are available in each rental. Seaflats can not be held responsible for theft committed in your rental, in your car or in the compound of the residence. The valuable goods must remain under the supervision of the client.

  1. CLAIMS

Any complaint relating to a stay must be sent, under penalty of foreclosure, by registered letter with A.R. within 8 days following the stay.

  1. INTERNAL RULES

All customers are required to comply with the rules of the residence and apartments under penalty of up to the termination of the contract.

Any behavior contrary to morality and public order will cause the establishment to ask the client to leave the accommodation without any compensation and / or without any refund if a payment has already been made.

You are deemed to have read and accepted these elements of the internal rules and to respect them during your stay:
In case of late arrival or last minute impediment, it is imperative to prevent our services.
The key to your rental will be given on arrival at the reception and they must be returned upon departure.
During your stay, we ask you to respect all the safety instructions as they will be displayed.
We ask our customers to avoid any noise after 10 pm.
The day of your departure, the hirings must be released before 11h. Although we do a cleaning in the accommodation at the end of your stay, you are asked to leave the place as clean as you found it (crockery, garbage out, no degradation or theft of equipment). A fixed amount of 65€ will be charged if the state of the accommodation requires a thorough or unusual cleaning.

  1. IMAGE RIGHTS

The reuse of Seaflats photos and other visuals for any personal or other use is prohibited.

  1. PROOF CONVENTION

The entry of the required banking information, as well as the acceptance of these general conditions and the voucher or the reservation request, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature. The computerized registers kept in the computer systems of sabeeapp.com will be kept under reasonable conditions of safety and considered as proof of communications, orders and payments between the parties. The customer is informed that his IP address is registered at the time of booking. Sabee, as a professional, is committed to the institution to take all measures of security and confidentiality of the data.

  1. FORCE MAJEURE

Force majeure means any event external to the parties that is both unpredictable and insurmountable and which prevents either the customer or the institution from fulfilling all or part of the obligations set out in the contract. Are regarded as case of force majeure or fortuitous case those usually recognized by the jurisprudence of the French Courts and Courts. Each party can not be held responsible towards the other party in case of non-fulfillment of its obligations resulting from a force majeure event. It is expressly agreed that force majeure suspends the fulfillment of mutual obligations by the parties and that each party bears the costs arising therefrom.

  1. LITIGATION

These General Terms and Conditions of Sale are governed by the law of the country of marketing (France) without hindering the mandatory protective provisions that may be applicable in the country of residence of the consumers.

  1. VALIDITY OF GENERAL TERMS AND CONDITIONS

The present general conditions of sale can be modified at any time and / or completed by the establishment. In this case, the new version of the general conditions of sale will be put online by Seaflats. As soon as it is online, the new version of the general sales conditions will apply automatically for all customers.
